What is mediation and what is the role of mediation in a North County divorce? Mediation is a neutral setting that is intended to provide a calm, productive and insightful process that helps to identify, clarify and resolve disputes between two people going through a divorce.

The mediator should have extensive experience in family law, as well as all aspects of divorce and how the Courts here in San Diego usually handle every aspect of a divorce case. The successful mediator will establish guidelines for behavior and process, ensuring each party is heard and get down to the genuine issues in dispute and what is underneath them.

The mediator makes suggestions and provides alternative solutions for the couple to consider and discuss. The couple and their representatives are free to provide their own solutions and recommendations. Neither party is bound to accept the input or recommendations of the mediator.

Mediation is a non-confrontational process that helps to resolve disagreement between the parties in a timely and cost-effective manner. The parties will almost always be required to participate in mediation prior to bringing a dispute before the family law Court in Carlsbad.
