Are you involved in a dispute over spousal support in a North County or Carlsbad divorce? Spousal support is one of the issues that causes disagreement between divorcing couples here in North County. Unlike child support, which is based upon established guidelines (for the most part), spousal support is much more “negotiable” and is based on several factors based upon your unique circumstance.

Generally speaking, the Court will often look at the established lifestyle the couple enjoyed during the marriage, as well as the length of the marriage and the contributions of each partner.
Did one of the parties give up work to stay home, manage the household and/or raise children? Did one of the parties support the other as they pursued a degree or professional license? There are obvious limitations based upon income and other support factors including child support.
Our attorneys work to understand your goals and objectives and the support that will be necessary to provide for each party going forward. If the marriage lasted less than ten years the Court will usually favor limiting the duration of spousal support, and may issue a “Gavron Warning” to the party receiving support.
The Gavron Warning basically instructs the recipient to seek work and to gain a measure of financial independence within a period of years. The Court will look at the quality of work and associated income, and compare it to the past work experience, education and abilities of the party receiving support.
