Will Spousal Support Be Enough and How Long Does it Last?

Pierre Domercq Spousal Support

How long does spousal support last in a North County or Carlsbad divorce and will it be enough to be able to support a separate household? Questions of spousal support are not as clearly defined in California law as the child support calculations guidelines. Therefore, spousal support is usually a negotiation between the parties or the result of mediation or ultimately litigation.
While California law does not specifically calculate spousal support it does attribute several factors which the court must take into consideration, including but not limited to:
The age and health of the parties
The duration of the marriage itself
The financial capacity of each party and lifestyle prior to the divorce
Education and employment history
The sacrifice of one spouse to support another while they finished education or sought a professional license
The experienced attorneys at Burke & Domercq guide our clients through spousal support conversations, negotiation, mediation and when necessary litigation. Dan Burke & Pierre Domercq each have decades of experience in North County family law courts. This experience informs the sound advice and counsel we provide throughout the process.
It is also important to note that spousal support does not often continue until death. In cases where a marriage lasted a significant number of years the term of spousal support is often longer. While the duration of the marriage itself will have an impact on the duration of spousal support, the court will often issue a “Gavron Warning” to the recipient of spousal support. The Gavron Warning expresses the court’s expectation for the recipient to become self-sustaining within a given period of time.
