Protecting Your Child Custody Goals in a Divorce

On Behalf of | Jul 18, 2019 | Child Custody and Visitation

What are the factors which you should consider when protecting your child custody goals in a divorce?  How will Carlsbad Family Law Courts view your position in the case?

It is important to consider the actions you take at every step in the divorce process.  This begins prior to the actual filing a divorce through the final decree.  The primary considerations our Courts will base these decisions upon include:

  • What is in the best interests of the child(ren)?
  • Which parent is more likely to be supportive of frequent and continuing quality time between the child(ren) and the other parent?
  • It is generally in the child’s best interest to spend roughly equivalent quality time with each parent.

Therefore, protecting your child custody goals in a divorce will often depend upon the written and documented communications between you and the other parent.  This includes maintaining good communications around the children themselves.  It is best not to say anything derogatory about the other parent in front of a child.  Be very cautious in all communications, especially texts and emails.  Understand all “private” social media is ultimately discoverable in a contested child custody hearing and will likely be presented as evidence.

The experienced family law attorneys at Burke & Domercq are also Certified Specialists in California family law.  We provide sound counsel and advice including protecting your child custody goals in a divorce.  We help you to understand the importance of staying involved in the child’s day-to-day activities.  Pick them up on time, and stay involved in transportation to and from school or extra-curricular events.  Maintain strong and positive communications with the child’s teacher(s) and school authorities, as well as healthcare professionals.

The Court will be looking for evidence that you will not only be a great parent to the child, but will support what is in their best interests.  If protecting your child custody goals in a divorce is important to you we invite you to contact Burke & Domercq or call 760-389-3927 to learn more or schedule an appointment with one of our attorneys.  It is important to be well informed by experienced counsel throughout the divorce process to ensure the best outcome in your case.
