A Few Misconceptions About Divorce in San Diego

On Behalf of | Sep 25, 2021 | Divorce

While many of the old myths about divorce have gone by the wayside, there are a still a few misconceptions about divorce in San Diego.  What should you know if you are considering a divorce?

One of the major misconceptions about divorce in San Diego is attorneys drive up the cost of a divorce.  The cost of your divorce and the time it will take to complete are directly tied to the amount of disagreement between you and your spouse and your ability to work through these issues and ultimately reach agreement.

Many people used to belief that mothers had some sort of legal priority when it comes to child custody and parenting time.  This is no longer the case.  The Court will look at married parents equally from a gender point of view.  The Court is more concerned with the ability of each party to parent the child and place the best interests of the child(ren) above their own.  It is not only in your interests to clearly demonstrate your ability and commitment to sound parenting, it is in your interests to show the Court you are prepared to co-parent.

Another of the misconceptions about divorce in San Diego relates to issues of support.  It may surprise you to learn that child support and/or spousal support is not always awarded to the woman/mother.  Both forms of support are based upon the needs of the recipient, the abilities of the payor and the lifestyle enjoyed by the parties during the course of the marriage.  There are many other factors which will come into play as the Court weighs the need for, amount and duration of associated support.

While there are many misconceptions about divorce in San Diego one of the most significant may be that you can accomplish a divorce without an attorney.  It is important to note that more than 80% of the divorces in California are filed by one of the parties (without an attorney).  It is also important to note that almost two-thirds of those who file on their own extend the timeframe of the divorce to well over a year and ultimately both parties wind up hiring an attorney before the issues of the divorce can be resolved and finalized.

The fastest and most efficient way to complete a divorce is to work with an attorney who understands your goals and objectives while providing sound counsel and strategic insight at each point of the process.
