What Is a Domestic Violence Restraining Order (DVRO)?
A domestic violence restraining order (DVRO) is a court order that protects individuals from abuse or threats of abuse by someone they have a close relationship with, such as a spouse, cohabitant, or family member.
Under the Domestic Violence Prevention Act (Cal. Fam. Code § 6200), the purpose of a DVRO is to provide safety and prevent future harm by prohibiting the restrained individual from contacting, harassing, or coming near the protected party.
Our restraining order attorneys can guide you through the process of filing a restraining order and represent you at any subsequent hearings. We can also protect your rights if a restraining order is filed against you.
Types of Restraining Orders in California
Emergency Protective Orders (EPOs)
An EPO is a short-term restraining order issued by law enforcement to provide immediate protection lasting up to 7 days. Police can request an EPO after a domestic violence incident to provide temporary relief until a temporary restraining order (TRO) hearing can be scheduled (Cal. Fam. Code § 6250).
Temporary Restraining Orders (TROs)
A TRO can be requested by filing a petition in family court. These orders are typically granted for up to 21 days or until the hearing for a permanent restraining order is held. It offers immediate protection by prohibiting contact and harassment from the abuser (Cal. Fam. Code § 240).
Permanent Restraining Orders (Post-Hearing Restraining Orders)
After a court hearing, a judge may issue a permanent restraining order, which can last up to 5 years and be renewed if necessary. These orders are granted when evidence of abuse meets legal criteria and focuses on the long-term safety of the protected individual (Cal. Fam. Code § 6345).
How Long Do Restraining Orders Last in California?
The duration of a restraining order depends on its type. Permanent restraining orders can last up to five years with the potential for renewal, while emergency and temporary restraining orders (EPOs and TROs) are intended to provide short-term protection until a hearing is held. Whether you’re requesting a DVRO or defending against one, consulting a trusted lawyer is paramount to understanding these timelines and renewal options.
