How Does Domestic Violence Affect a Child Custody Case in San Diego

On Behalf of | Aug 13, 2021 | Domestic Violence

How does domestic violence affect a child custody case in San Diego?  Unfortunately, according to the National Coalition against Domestic Violence (NCADV) more than 10 million adults experience some form of domestic violence each year in the United States.  While many in this number are repeat victims, the amount of abuse is simply staggering.

Domestic violence isn’t only physical in nature.  It extends to spoken or written action against a family member, partner, or spouse.  The physical actions associated with domestic violence usually involve hitting, pushing, kicking or sexual assault. Emotional abuse can extend to shouting, threatening, stalking, or purposefully frightening another person.

The impact of domestic violence upon the victim(s) is profound.  This is especially true in children.  The NCADV noted more than 15 million children live in homes where incidents of domestic violence have occurred.  Psychiatrists and psychologists have documented several prevailing impacts on children in domestic violence situations including anxiety, depression, obesity and even diabetes and vascular issues.  How will these incidents and symptoms of domestic violence affect a child custody case in San Diego?

California Family Law requires the Judge to give special attention to matters which involve domestic violence.  There are special laws which have been written specifically with domestic violence in mind as it pertains to family law.  The primary considerations of our Family Courts in any matter involving children are based upon the “child’s best interest.” There are many ways in which allegations of domestic violence affect a child custody case in San Diego.  The Judge will review all aspects of historical data, past and present.  Child custody and parenting time may be denied altogether, or it may be restricted to “supervised visitation” to protect the safety and well-being of every child.
