Interstate Child Custody Issues During or After Your San Diego Divorce

On Behalf of | Jan 21, 2021 | Child Custody and Visitation

How does one manage interstate child custody issues during or after your San Diego divorce?  What happens when one of the parents wants or is required by their job to move to another city or state?  Can you take your children with you while co-parenting if you wish to move out of the area or out of state?

There are many reasons why you might face interstate child custody issues during or after your San Diego divorce.  In some cases, the move is based upon the support of family, friends and additional resources to support the child(ren).  In other cases it might be based upon a job transfer or a new relationship or marriage.  What Court has jurisdiction over the case and what factors will contribute to any decisions the Court ultimately reaches?

If you learn your former or soon-to-be ex spouse is considering a move out of the area or out of state while you are co-parenting you must take immediate action to protect your legal parenting rights.  It is not unusual for one parent to take the children and relocate and then file for emergency venue in their new state based upon allegations of domestic violence, child abuse or neglect.

Once another Court asserts “venue” in a child custody or parenting time case the cost and time associated with the matter will substantially increase.  If you suspect a move is even being considered you should immediately seek the advice and counsel of the Certified Family Law Specialists at Burke & Domercq.

Interstate child custody issues during  or after your San Diego divorce are usually decided on what is in the best interests of the child(ren).  Which venue provides the greatest amount of resources, support, family, education and health care for the child?  What about the interruption of the child’s existing relationships with school, family, friends and extra-curricular activities?

The Court will weigh these issues carefully. Protect your own interests and contact us or call 760-389-3927 to schedule an appointment for a remote or socially distanced consultation with one of our experienced Certified Family Law Specialists.
