What is a Contested Divorce in San Diego?

Pierre Domercq Divorce

What is a contested divorce in San Diego?  A contested divorce is the result of any area of disagreement between the spouses relating to the divorce.  The disagreement may be the result of a dispute regarding some facts associated with the case such as the value of a business or professional practice, or questions regarding the actual date of separation.

The second type of disagreement in a contested divorce in San Diego is a legal dispute.  A legal dispute may involve issues such as child custody and/or parenting time or the amount and duration of spousal support.

The third type of dispute involves the unreasonable behavior of one of the parties who is attempting to control or manipulate the process or is simply consumed by anger.  One of the spouses may have a personality disorder or another diagnosed condition which makes reasoned negotiation more challenging.

The Certified Family Law Specialists at Burke & Domercq have decades of experience resolving disputes and helping our clients to complete a contested divorce in San Diego while protecting their goals and objectives.  There are generally 3 ways to resolve an area of dispute in your divorce:

Negotiation – either direct negotiations between the parties or with the assistance of their legal representatives

Mediation – a private, confidential and neutral legal venue where a third party (the mediator) guides the process to identify all aspects of the disagreement, identify potential alternatives and ultimate reach an agreement on all or part of the issue(s) at hand.

Trial before Family Court – the Judge will hear the facts and render a decision.
