When Seniors Get a Divorce in San Diego

On Behalf of | Jun 3, 2021 | Divorce

Are you approaching or entering retirement and considering the end of your marriage?  You’re not alone.  Gray divorce rates (when the parties are above the age of 50) have substantially increased over the past decade.  What are some of the most important issues when seniors get a divorce in San Diego?

Divorce has nearly doubled for those over the age of 50 in California.  Most often, the underlying marriage may have lasted 20 to 30 years or longer.  This type of divorce case presents unique legal and financial challenges.  This is why it is so important to speak with one of the Certified Family Law Specialists at Burke & Domercq.  We have decades of experience in Family Law and provide sound advice and counsel.

When seniors get a divorce in San Diego it is best to pre-plan as much as possible.  The issues in your divorce can include but are not limited to:

  • Who is going to keep the family home?
  • How do you handle retirement plans, pensions and/or Social Security in a divorce?
  • What happens to a family business or professional practice?
  • Will spousal support be awarded in my case?
  • Who gets to keep the pet(s)?

There are a few things which are helpful to understand from the outset of the discussion. The first is that the cost of your divorce is directly related to the amount of disagreement between you and your soon-to-be former spouse and your ability to efficiently resolve these issues.

Mediation can be an excellent tool in your case.  Mediation is private, confidential and keeps your personal business out of the public record.  It also helps to remove much of the emotional burden while focusing on resolving issues in order to reach an agreement.

If you have children it is important to prepare for how you will tell them about your decision.  Talk to your children.  Be as open as possible with them without getting into the details.  Their love and encouragement and simply spending time with them and your grandchildren can help everyone to make the transition.

You will need to have a plan for how you will manage the process and take care of yourself as well.  We can share strategies to reduce the contentiousness and harsh communications to make the process more productive and less emotionally burdensome.  It helps to know you will get through this chapter in your life.  Part of that process is to focus on creating the best opportunity for a positive path moving forward.

We invite you to work with the experienced and proven Certified Family Law Specialists at Burke & Domercq.  The decision to end a marriage is quite legally, financially and emotionally complex.  We will help you through every step, provide sound advice and work with you to develop strategies to protect what is important to you.
